GENERAL TERMS AND CONDITIONS OF SALE
This website is operated by La maison FRANC, registered in the French Business and Establishments Directory under number 824736805, with its registered office located at 38 impasse de Turcan, 84120 PERTUIS - FRANCE.
On this site, the terms “we”, “our”, and “us” refer to FRANC 1884, including lavender hearts, lavender balls, or lavender spindles.
Article 1 – Entirety
These general terms and conditions represent the entire obligations of the parties. In this sense, the buyer is deemed to accept them without reservation.
These general terms and conditions of sale apply to the exclusion of all other conditions, including those applicable to in-store sales or via other distribution and marketing channels.

The seller and the buyer agree that these general terms and conditions exclusively govern their relationship. The seller reserves the right to modify the general terms and conditions from time to time. The updated terms will apply immediately upon being posted online.
If a sales condition is missing, it shall be governed by the prevailing practices in the distance selling sector for companies based in France.
Article 2 – Purpose
These general terms and conditions aim to define the rights and obligations of the parties in the context of online sales of goods offered by the seller to the buyer via the website:
These terms apply to all purchases of products available on www.franc1884.com. The buyer acknowledges having read and accepted these general terms and conditions prior to any immediate purchase or order placement. Accordingly, they are binding in accordance with Article 1119 of the French Civil Code.
Article 3 – Pre-contractual Information
3.1 The buyer acknowledges having received, prior to placing the order and concluding the contract, in a clear and comprehensible manner, these general terms and conditions of sale and all information listed under Article L. 221-5 of the French Consumer Code.
3.2 The following information is provided clearly and understandably to the buyer:

Any additional charges for transportation, delivery, or postage, and any other possible fees;

In the absence of immediate performance, the date or timeframe within which the provider commits to delivering the goods or performing the service, regardless of its price.
3.3 The seller provides the buyer with the following information:

Its name or company name, the physical address of its establishment and, if different, its registered office, telephone number, and email address;

The payment, delivery, and contract performance methods, as well as the procedures for handling complaints;

In case of sale, the existence and terms of exercising the legal guarantee of conformity under Articles L. 217-1 et seq. of the Consumer Code, the hidden defects guarantee under Articles 1641 et seq. of the Civil Code, and, if applicable, the commercial guarantee and after-sales service under Articles L. 217-15 and L. 217-17 of the Consumer Code.
3.4 Regarding digital content, the seller indicates any relevant interoperability with certain hardware or software that the professional knows or should reasonably know.
Article 4 – The Order
The buyer can place an order online from the online catalog using the provided form for any product, subject to stock availability.
If a product is unavailable, the buyer will be informed by email.
To validate the order, the buyer must select the delivery address and method, and confirm the payment method.
The sale is considered final:

After the buyer receives an email confirming acceptance of the order by the seller;

And after the seller has received full payment.
Each order implies acceptance of the prices and product descriptions available for sale. Any disputes on this point will be handled within the framework of possible exchanges and guarantees listed below.
In certain cases, such as non-payment, incorrect address, or other account issues, the seller reserves the right to block the buyer’s order until the problem is resolved.
Cancellation of this product order and any possible refund will then be processed, while the remainder of the order remains final.

An invoice is available for download in the order confirmation email; otherwise, the buyer can also contact contact@franc1884.com.
Article 5 – Electronic Signature
Providing the buyer’s credit card number online and finalizing the order constitutes proof of the buyer’s agreement:

To pay the amounts due under the order;

To sign and expressly accept all transactions performed.
In case of fraudulent use of the credit card, the buyer is requested to contact contact@franc1884.com immediately.
Article 6 – Order Confirmation
The seller provides the buyer with a copy of the order confirmation by email, confirming the express commitment of the parties.
Article 7 – Proof of Transaction
Computerized records stored in the seller’s IT systems under reasonable security conditions will be considered proof of communications, orders, and payments between the parties. Archiving of order forms and invoices is done on reliable and durable media that can serve as evidence.
Article 8 – Product Information
Products governed by these general terms are those listed on the FRANC 1884 website as sold and shipped by FRANC 1884. Products are offered while stocks last.
Products are described and presented as accurately as possible. However, the seller cannot be held responsible for errors or omissions in the presentation.
Product photographs are non-contractual.
Article 9 – Prices
The seller reserves the right to change prices at any time but will apply the rates in effect at the time of the order, subject to stock availability.
Prices are in euros and exclude delivery fees, which are charged separately and displayed before order confirmation. Prices include VAT. Full payment must be made at the time of the order; no payment will be considered a deposit.
Any new taxes or contributions, including environmental taxes, may be reflected in product prices.
Article 10 – Payment Method
Orders are subject to mandatory payment. The buyer may choose from all payment methods provided by the seller on the website. The buyer guarantees that they are authorized to use the chosen payment method at the time of order confirmation.
The seller reserves the right to suspend order processing or delivery in case of payment refusal by the card issuer or non-payment. The seller may refuse delivery or fulfillment if a previous order has not been fully or partially paid or if a payment dispute exists.
Payment is due in full at the time of the order.
Article 11 – Product Availability, Refund, Termination
Except in cases of force majeure or announced online store closure, shipping times are, subject to stock availability, as indicated. Shipping times start from the order confirmation date.
Shipments are processed within 48 hours, Monday to Friday. Weekend orders are shipped on Monday.
Delivery takes 2–3 business days in France and 5–15 days worldwide.
If delivery deadlines are not met, the buyer must first give the seller a reasonable additional period to perform the contract. If the seller fails to comply, the buyer may terminate the contract.
Termination formalities must be sent by registered letter with acknowledgment of receipt to Philippe FRANC, 16 rue Henri de Savornin, 84160 LOURMARIN, FRANCE.
The seller must refund all sums paid within 14 days of contract termination.
In case of product unavailability, the buyer will be informed and may cancel the order or request a refund or exchange.
Article 12 – Delivery Terms
Delivery means transferring physical possession or control of the goods to the consumer. Delivery occurs after payment confirmation.
Products are delivered to the address provided by the buyer. Any shipment returned due to an incorrect address will be reshipped at the buyer’s expense.
If the original packaging is damaged upon delivery, the buyer must check the items and refuse the package if damaged, noting the issue on the delivery slip.
Claims for returns must be made within 14 days of delivery. Returned products must be in original condition with all accessories and documentation.
Article 13 – Delivery Errors
The buyer must report delivery errors or non-conformity by email to contact@franc1884.com on the delivery day or the next business day. Claims outside this period are rejected.
Products to be exchanged or refunded must be returned in original packaging via registered shipping to: Philippe FRANC, 16 rue Henri de Savornin, 84160 LOURMARIN, FRANCE. Return costs are borne by the seller.
Article 14 – Transfer of Risk
Ownership of the sold goods transfers to the buyer once the parties agree on the goods and price. Risk of loss or damage transfers upon acceptance of the order.
Delivery is deemed complete once the goods are handed over to the carrier.
Article 15 – Legal Guarantees
La maison FRANC guarantees product conformity under Articles L. 217-4 et seq. of the Consumer Code and hidden defects under Articles 1641 et seq. of the Civil Code.
Article 16 – Right of Withdrawal
The buyer has 14 working days from delivery to return any item and request an exchange or refund, excluding return shipping costs.
Products must be returned in original packaging and perfect condition with the order number or invoice. Damaged or incomplete products are not accepted.
Withdrawal may be exercised via contact@franc1884.com. Refunds cover the product price and delivery costs; returns are at the buyer’s expense. Exchanges are not accepted.
Article 17 – Force Majeure
Events beyond the parties’ control preventing contract execution are considered force majeure and suspend obligations.
The affected party must inform the other immediately. Examples include transport blockages, natural disasters, network failures, etc.
If the event exceeds three months, the affected party may terminate the contract.
Article 18 – Intellectual Property
All site content (technical documents, drawings, photos, etc.) is the property of Philippe FRANC. Any reproduction is strictly prohibited.
Article 19 – Data Protection
Buyer data is necessary to process orders and invoices and may be shared with partners handling order execution and payment. The processing complies with CNIL regulations. Buyers have rights to access, modify, or oppose data.
Article 20 – Partial Invalidity
If any provision is invalid, the other provisions remain in effect.
Article 21 – Non-Waiver
Failure to enforce a provision does not constitute waiver of that right in the future.
Article 22 – Headings
Clause headings have no interpretative value.
Article 23 – Language
The French version prevails in case of translation discrepancies.
Article 24 – Mediation
The buyer may seek alternative dispute resolution, including consumer mediation or conciliation.
Article 25 – Governing Law
These terms are governed by French law, excluding the Vienna Convention. In case of dispute, the buyer must first contact the seller to seek an amicable solution.
